Most lawyers and the people they represent would agree that resolving medical negligence claims through a mutually agreed upon settlement rather than through a jury verdict at trial is the better path to take.

Mediation serves that goal. It is an efficient means to settle a claim In which both parties have a risk of losing if the case goes to trial. Mediation is voluntary and non binding. Even when a settlement is not reached during a mediation attempt, the parties have not given up any rights and they may proceed through the litigation process as if the mediation did not occur.

Why Mediate

You Get To Choose

Mediation allows parties to actively engage and collaborate toward a resolution. Unlike adversarial methods, it empowers individuals to take ownership of the outcome.

Trials Are Expensive

Mediation typically costs less than litigation. Parties avoid court fees, attorney expenses, and lengthy proceedings. This financial efficiency benefits both individuals and organizations.

Confidentiality

Mediation occurs behind closed doors, ensuring privacy. Participants can freely discuss their concerns without fear of public exposure. Confidentiality encourages open dialogue and creative problem-solving.

Flexibility

Mediation allows custom-made solutions. Parties can explore creative options beyond legal remedies, addressing underlying interests and needs. This can open the door to the possibility of a win-win outcome.

Preserving Relationships

A key benefit of mediation is collaboration rather than confrontation. By maintaining respectful communication, parties can preserve relationships. Often the witnesses required to establish your case in litigation requires the testimony of friends, relatives, or work colleagues – some of whom do not want to participate in the litigation process.

Time to Resolution

Mediation is often quicker than litigation. Parties can schedule sessions promptly, avoiding lengthy court delays. Swift resolution minimizes stress and allows individuals to move forward.
